Pennsylvania Superior Court Upholds Successful Suppression Motion Filed in the Columbia County Court of Common Pleas
The Defendant was arrested by the Berwick police department and charged with numerous crimes as a result of an illegal traffic stop, confession and search of Defendant's home, including Possession with Intent to Deliver a Controlled Substance, Possession of a Controlled Substance, and Possession of Drug Paraphernalia.
Attorney Michael A. Sklarosky filed a Motion to Suppress, alleging that the traffic stop was illegal and as a result, the subsequent confession and search were "fruits of the poisonous tree." After a hearing on the Motion and submission of briefs, the court agreed and granted the Defendant's Motion, suppressing all of the illegally obtained evidence.
