Luzerne County Court Grants Defendant's Motion to Suppress

The Defendant was arrested by the Hazleton City police and charged with numerous crimes as a result of a bar fight that spilled out into the street, including Resisting Arrest, Possession of Drug Paraphernalia and Possession of a Controlled Substance.  

Attorney Michael A. Sklarosky filed a Motion to Suppress, alleging that the arrest, detention, and search of the Defendant was illegal, as it was not supported by Probable Cause.  After a hearing on the Motion, the court agreed and granted the Defendant's Motion.  As a result, the Commonwealth filed a Motion to Nolle Pross Charges, meaning that they were no longer able to proceed with their case against the Defendant.
